By creating an account and using YotaPoint, you signify that you have read, understood, and agree to be bound by these Terms of Use and our Privacy Policy. These terms may be updated periodically to reflect changes in our practices or for legal or regulatory reasons.

To access certain features of YotaPoint, including posting products for sale, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your password and other login credentials and for any activities or actions under your account. You must notify us immediately of any breach of security or unauthorized use of your account. YotaPoint will not be liable for any loss or damage arising from your failure to comply with the above requirements.

As a condition of your use of YotaPoint, you agree to comply with all applicable laws and regulations and to refrain from engaging in the following prohibited activities:

• Posting or transmitting any content that is unlawful, harmful, harassing, defamatory, obscene, or otherwise objectionable.
• Listing or selling counterfeit, stolen, or unauthorized products, or infringing the intellectual property rights of any third party.
• Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
• Engaging in any form of harassment, abuse, intimidation, or threats against other users or individuals.
• Using automated systems, scripts, or bots to scrape, harvest, or gather data from YotaPoint without our express written consent.
• Interfering with or disrupting the security, integrity, or performance of the application or the services offered through it.
• Using YotaPoint in any manner that could damage, disable, overburden, or impair the application or interfere with any other party's use of it.

When posting a product on YotaPoint, you must provide accurate, clear, and comprehensive information about the product, including its condition, pricing, and any specific attributes or details that may affect a buyer's decision. You agree to upload high-quality images that accurately represent the product being sold.

You are solely responsible for ensuring that your listings comply with all applicable laws and regulations regarding the sale of the items, including but not limited to copyright, trademark, and consumer protection laws.

Furthermore, you must ensure that you have the legal right to sell the items you list on YotaPoint. This includes, but is not limited to, ensuring that you have obtained all necessary licenses or permissions and that the sale of the item does not violate any third-party rights. YotaPoint reserves the right to remove any listings that do not comply with these requirements or that we deem to be inappropriate or unlawful.

You retain ownership of the content you post on YotaPoint, including product listings, images, and descriptions. However, by posting content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, and transferable license to use, reproduce, distribute, modify, adapt, publish, and publicly display your content in connection with our services and for marketing purposes.

This license allows us to promote YotaPoint and to share your content with other users and third parties. We will not sell your content to others or use it for purposes outside the scope of this agreement without your permission.

YotaPoint acts as a platform for users to buy and sell products; however, we are not involved in the actual transaction between buyers and sellers. Therefore, we do not guarantee the quality, safety, or legality of the products listed on our platform, nor do we guarantee that sellers will actually sell the items they list or that buyers will purchase those items.

If you engage in a transaction, you agree to abide by the terms set forth in the listing and to conduct the transaction in good faith. In the event of a dispute, we encourage you to communicate directly with the other party to reach a resolution.

YotaPoint is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the application will be uninterrupted, secure, or free from errors or that any defects will be corrected.

To the fullest extent permitted by law, YotaPoint disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, YotaPoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the application or services, even if we have been advised of the possibility of such damages.

This includes, but is not limited to, any damages resulting from loss of profits, data, use, goodwill, or other intangible losses resulting from (i) your access to or use of, or inability to access or use, the application; (ii) any conduct or content of any third party on the application; (iii) any content obtained from the application; and (iv) unauthorized access, use, or alteration of your transmissions or content.

We may modify these Terms of Use at any time, in our sole discretion. Any changes will be effective immediately upon posting on our application, and you agree to be bound by such changes. We will notify you of any material changes via email or through a prominent notice on our application.

Your continued use of YotaPoint following any changes constitutes acceptance of the new terms. We encourage you to periodically review these terms for updates.

If any provision of these Terms of Use is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these terms shall remain in full force and effect.
